Terms of Service
These Terms of Service govern your use of Apex Roof & Exterior services. Please read them carefully to understand your rights, our operational limitations, and the standard to which we deliver our cleaning and exterior maintenance services.
Service Agreements
1. Eligibility & Property Access
By scheduling a service with Apex Roof & Exterior, you confirm that you are at least 18 years of age and hold the legal authority to authorize cleaning services at the designated property. You agree to provide our crews with unhindered access to the work area, including a functioning outdoor water supply and necessary electrical outlets during the scheduled service window.
2. General Cleaning Terms
Prior to our arrival, the client is responsible for clearing the immediate service zone. This includes moving fragile outdoor items, patio furniture, potted plants, and vehicles away from the cleaning area. Apex Roof & Exterior is not responsible for water damage to items left in the designated cleaning zone, nor are we liable for damage resulting from unsealed windows, faulty weatherstripping, or pre-existing structural wear.
3. Roof Cleaning & Soft Washing
Apex Roof & Exterior utilizes a low-pressure soft wash method specifically designed to protect roofing materials while effectively removing organic growth. We strictly disclaim liability for pre-existing damage that may become visible post-cleaning. This includes, but is not limited to: loose shingles, granular loss, oxidized paint, faded siding, or compromised flashing. Please note that all roof cleaning services are heavily weather-dependent and may be rescheduled at our complete discretion to ensure the safety of our crew and the integrity of your property.
4. Scheduling & Cancellations
We provide estimated arrival windows for all appointments. Due to the variable nature of exterior work and unforeseen routing conditions, arrival times are estimates and not guaranteed. Weather delays are common and handled proactively. If you need to cancel or reschedule, you must provide notice at least 48 hours in advance. Failure to do so may result in a cancellation fee applied to your account.
SMS & Messaging Policy
Apex Roof & Exterior is committed to transparency. This disclosure outlines how we communicate via text messaging and your rights regarding these messages.
Consent
By providing your mobile number through our online forms, scheduling requests, or directly to our staff, you expressly consent to receive automated and non-automated text messages (SMS) from Apex Roof & Exterior. Messages may include service quotes, appointment reminders, scheduling updates, and relevant service promotions.
Opt-out
You may cancel these communications at any time. Reply STOP to any message from us to instantly unsubscribe. You may also reply HELP if you require customer support or need further assistance. Following a cancellation request, you may receive one final automated message confirming your Opt-out status. No further messages will be sent unless re-initiated by you.
Frequency & Carrier Fees
Message frequency varies depending on your active service requests and appointments. Message and data rates may apply based on your mobile carrier plan. Carriers are not liable for delayed or undelivered messages. Your mobile information will not be shared with third parties or affiliates for marketing/promotional purposes without your explicit consent. Legal & Governance
Limitation of Liability
Apex Roof & Exterior shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. Our total liability for any claim arising out of or relating to our services shall not exceed the amount paid by you for the specific service in question. We are not responsible for pre-existing damage to roofs, siding, or property.
Indemnification
You agree to indemnify, defend, and hold harmless Apex Roof & Exterior, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.
Intellectual Property
All content on our website and provided in our materials, including text, graphics, logos, images, and software, is the property of Apex Roof & Exterior or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.
Dispute Resolution & Governing Law
These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which Apex Roof & Exterior operates, without regard to its conflict of law principles. Any dispute arising from these Terms or our services shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
